The agency provides a range of services in the field of protection against unfair competition, including investigation of the situation, implementation of legal analysis, preparation of legal propositions, representation of the client’s interests and their legal support in administrative and legal procedures for protecting against unfair competition.
The administrative and legal procedure mainly comes down to the filing of a statement by the owner or his representative to the Antimonopoly Committee of Ukraine. This action is effective if it’s possible to qualify the infringement of a trademark as an act of unfair competition. In this case, the Antimonopoly Committee has the authorization to make one of the following decisions:
- Acknowledge the fact of unfair competition;
- Suppress the unfair competition;
- Impose fines;
- Confiscate the counterfeit goods.
